Agreement to these terms
These Terms of Service ('Terms') are a binding agreement between you and Echo Media Systems, a product of One Infinity Labs, Inc. ('Echo', 'we', 'us'). By creating an account or using Echo at echo.1labs.app, you agree to these Terms. If you are using Echo on behalf of a company or other organization, you represent that you have authority to bind that organization, and 'you' refers to it.
If you do not agree to these Terms, do not use the service.
The service
Echo is an AI content-repurposing service. You upload audio, video, or text ('Customer Content'), and Echo processes it — including via third-party AI providers — to generate transcripts and derivative content such as clips, posts, summaries, and other formats ('Output').
AI-generated Output can contain errors, omissions, or inaccuracies. You are responsible for reviewing Output before relying on it or publishing it. Echo does not provide legal, medical, financial, or other professional advice.
Your account
You must provide accurate account information and keep it up to date. You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at support@1labs.ai if you suspect unauthorized access to your account.
You must be at least 16 years old (or the higher minimum age required in your jurisdiction) to use Echo.
Your content and our license to it
You retain all ownership rights in your Customer Content. You grant Echo a limited, worldwide, non-exclusive license to host, store, process, transmit, and display your Customer Content solely as needed to operate and provide the service to you, including processing through the subprocessors listed in our Privacy Policy and Data Processing Addendum.
We do not use your Customer Content to train AI models.
As between you and Echo, you own the Output generated from your Customer Content, to the extent permitted by applicable law. You are responsible for how you use Output, including ensuring it does not infringe the rights of others.
Your responsibilities
You represent and warrant that you own, or have all rights and permissions necessary in, all Customer Content you upload, and that your use of Echo complies with applicable law and our Acceptable Use Policy.
The Acceptable Use Policy is part of these Terms. Violating it may result in suspension or termination of your account.
Plans, billing, and trials
Echo offers paid subscription plans: Starter at 29 US dollars per month and Pro at 79 US dollars per month, each with annual options at a discount. Subscriptions are sold and billed by Polar, acting as our merchant of record; Polar handles payment processing, applicable taxes, and invoicing.
New subscriptions begin with a 7-day free trial. You will not be charged if you cancel before the trial ends.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime via the customer portal; cancellation takes effect at the end of the current billing period, and you keep access until then.
If a renewal payment fails, we provide a 3-day grace period during which we retry the charge and notify you. If payment is not completed within the grace period, access to paid features is paused until billing is resolved.
Refunds are governed by our Refund and Cancellation Policy.
Echo's intellectual property
The Echo service — including its software, design, models of operation, and branding — is owned by One Infinity Labs, Inc. and its licensors. These Terms do not grant you any rights in the service other than the limited right to use it in accordance with these Terms. You may not copy, modify, reverse engineer, resell, or create derivative works of the service except as permitted by law.
Suspension and termination
You may stop using Echo and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms (including the Acceptable Use Policy), if required by law, or if your use poses a security or legal risk to Echo or others. Where reasonable, we will give you notice and an opportunity to cure before termination.
On account deletion, your Customer Content is deleted within 30 days as described in our Privacy Policy. Sections of these Terms that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) survive.
Disclaimers
Echo is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that Output will be accurate or fit for any particular use.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, even if advised of the possibility. To the maximum extent permitted by law, Echo's total aggregate liability arising out of or relating to the service is limited to the amounts you paid to us for the service in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
Indemnification
You will indemnify and hold harmless Echo and One Infinity Labs, Inc. from third-party claims arising out of your Customer Content, your use of Output, or your breach of these Terms, including reasonable legal fees, except to the extent caused by our own breach of these Terms.
Changes, governing law, and general terms
We may update these Terms from time to time. For material changes, we will give you advance notice by email or in the app; continued use of the service after the changes take effect constitutes acceptance. If you do not agree to updated Terms, you should stop using the service and may cancel your subscription.
These Terms are governed by the laws applicable to One Infinity Labs, Inc. in its jurisdiction of incorporation, without regard to conflict-of-laws rules, and disputes will be resolved in the courts of that jurisdiction unless applicable consumer law gives you the right to bring claims where you live.
If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with the policies they reference, are the entire agreement between you and Echo regarding the service.
